The Court sets aside the prohibition on the acquisition of TNT Express by UPS due to a procedural error

The European Commission’s decision prohibiting the acquisition of TNT Express by UPS must be set aside, the European Court of Justice confirmed in a judgement delivered on Wednesday 16 January (Case C-265/17 P).

In January 2013, the Commission vetoed the above-mentioned proposed acquisition because of the significant impediment to competition that the transaction would have created in the market for the international express delivery of small parcels in fifteen Member States (see EUROPE...
